The Central Consumer Protection Authority (CCPA) on Saturday issued an advisory warning the e-commerce entities which can be into promoting or facilitating sale of wi-fi jammers to shoppers by way of their e-commerce platforms to not promote them as possession and use want a license.
Sale and use of any wi-fi machine with out authorisation/license underneath the Indian Telegraph Act, 1885 or Indian Wireless Telegraphy Act (IWTA) 1933, until exempted by guidelines, is unlawful.
Jammers come underneath the purview of IWTA, 1933 and the Act lays down that license is required for possession and use of jammers.
As per the federal government pointers, jammers could also be allowed solely underneath distinctive circumstances, solely when authorised by Secretary (Security), Cabinet Secretariat, the Ministry of Consumer Affairs, Food and Public Distribution mentioned and suggested the customers to entry the rules at https://cabsec.gov.in/others/jammerpolicy.
E-commerce corporations warned
The Department of Telecommunication had issued an advisory on January 21, 2022 as regards to unlawful facilitation and sale of wi-fi jammers on on-line platforms. Also, the Department of Promotion of Industry and Internal Trade had issued a letter to all e-commerce entities to adjust to the principles and regulation laid down by the federal government in opposition to sale and buy of any sort of cell jammers.
Under Section 18 of the Consumer Protection Act, 2019, CCPA is empowered to guard, promote and implement the rights of shoppers as a category, and stop violation of shoppers’ rights. Further, CCPA is empowered to forestall unfair commerce practices and make sure that no individual engages himself in unfair commerce practices.
